Privacy policy

Jointly responsible within the meaning of Art. 5 lit. j FADP are the three companies behind Solarabteilung: Green Montagen GmbH in Arbon, Bräuer Solarvertrieb in Baar and Saracista Solutions in Muttenz. Full details are given in the legal notice.

It covers the website solarabteilung.ch, the forms on this website and contact by email or telephone. The websites of Green Montagen, Bräuer Solarvertrieb and rebeyo have their own privacy policies.

With every request your browser transmits technical details that are needed to deliver the page: IP address, date and time, the address requested, the referring page as well as browser and device identification. Our hosting provider processes these details to deliver the page, keep the service stable and fend off attacks. We do not analyse them on a personal level and do not combine them with other data.

This website uses no analytics, tracking or advertising services. There are no social media plugins, no ad networks and no profiling. The fonts are served from our own server, so no connection to a font provider is made.

While the website is under construction, it is protected by a password. Anyone who enters the password receives a technically necessary cookie so that it does not have to be entered on every visit. It contains no information about the person and expires after 30 days. Without this cookie the preview cannot be opened. We do not use any other cookies. Three items are stored locally in your browser so that the website works:

• the language you selected, so that the site opens in that language on your next visit
• your origin details on your first visit, that is the campaign parameters in the address, the referring page and the entry page. We only transmit these details if you submit a form, so that we know where an enquiry comes from. Without a form they never leave your browser.
• the fact that you dismissed the language suggestion, so that it does not appear again

You can refuse this storage at any time by blocking it in your browser or deleting the stored items (Art. 45c of the Swiss Telecommunications Act). The website keeps working, it simply no longer remembers your language choice.

Your entries in the partner check, that is industry, number of contacts, how you handle solar enquiries today and canton, are calculated directly in your browser. As long as you do not submit a form, they do not reach us. If you share your result through a link, these entries appear in the link address.

The partner check and the contact form allow you to send us your details. We then process:

• company, first and last name, email address and, if you wish, phone number
• industry, canton and your message
• the values you entered in the partner check and the figures calculated from them
• the language of the page, the source of the form, your origin details and your browser identification

We need these details to handle your enquiry, reply to you, send you the evaluation and prepare a possible collaboration. Without an email address we cannot reply. Every field that is not marked as mandatory is optional.

To fend off automated submissions we use a hidden field and check how much time passes between loading and submitting the form. Neither processes any additional personal data.

After submitting you receive a confirmation by email. We only send you advertising if you have expressly agreed to it.

While the website is under construction, you can sign up with your email address to receive a message as soon as it is live. For this we store your email address, the language of the page and the time you signed up. We use the address only for this one message and delete it as soon as the message has been sent. The basis is your consent, which you can withdraw at any time by emailing hallo@solarabteilung.ch. The same protection against automated sign-ups applies as for the other forms.

If you send us an email, we process your address and the content of your message in order to reply. Emails are not encrypted end to end on their way to us. Please do not send us sensitive personal data by email.

For the collaboration we process the contact details of the people in your business, the contract details, the projects and the invoicing data. The basis is the contract. We keep accounting records for ten years, as required by Art. 958f of the Swiss Code of Obligations.

Data about your own customers that you pass to us for a project is processed exclusively on your behalf and according to your instructions (processing on behalf under Art. 9 FADP). You remain responsible towards those customers. We set this out in a separate agreement to the partner contract.

Within Solarabteilung, the three participating companies have access to your details insofar as they need them for your enquiry or for a project. In addition we use service providers that process data on our behalf:

• hosting and delivery of the website
• the database in which enquiries are stored
• sending our emails
• our email mailbox

These providers may process the data only for us and only according to our instructions. We do not sell data and do not pass it on for third-party advertising. Authorities, grid operators or funding bodies receive data only where this is necessary for a specific project or where the law requires it. You can request the list of providers at hallo@solarabteilung.ch.

We process data in Switzerland or in Europe wherever possible. Some providers process data abroad:

• The enquiries from the forms are stored in a data centre in Ireland. Ireland is one of the states with adequate data protection under Annex 1 of the Swiss Data Protection Ordinance.
• The provider of this database is based in Singapore and can access it for operation and support. The basis is standard data protection clauses under Art. 16 para. 2 lit. d FADP.
• The website is delivered through a global server network operated by a company based in the United States. It is certified under the Swiss-U.S. Data Privacy Framework, for which the Federal Council recognises adequate data protection.
• Our hosting provider is based in the United States and in Sweden. The basis is standard data protection clauses.
• Our emails are sent through a service based in the United States. The basis is standard data protection clauses.

Despite these safeguards, access to data by authorities abroad cannot be ruled out.

We keep personal data for as long as we need it for the respective purpose. Enquiries that do not lead to a collaboration are deleted as soon as we no longer need them. Statutory retention obligations remain reserved, for example the ten years for accounting records.

The website is encrypted end to end with TLS, shown by the padlock in the address bar. The database cannot be written to directly from outside: forms run through our server, and an access restriction applies at database level. Only people who need it for their work have access.

At any time you can:

• ask whether and which data we process about you (Art. 25 FADP)
• have incorrect data corrected (Art. 32 FADP)
• request the deletion of your data or object to processing
• request your data in a common format (Art. 28 FADP)
• withdraw a consent you have given, without this making the processing carried out so far unlawful

An email to hallo@solarabteilung.ch is enough. We may ask for proof of identity so that your data does not end up with the wrong person. If you are not satisfied with our reply, you can contact the Federal Data Protection and Information Commissioner (FDPIC).

We do not take any decisions about you that are based solely on automated processing and have legal consequences for you (Art. 21 FADP). The partner check calculates, it decides nothing.

Our offer is aimed at businesses in Switzerland. Where the European General Data Protection Regulation applies in an individual case, we base the processing on the preparation and performance of a contract (Art. 6(1)(b) GDPR), on our legitimate interest in secure operation of the website and in handling enquiries (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR). In that case you additionally have the rights under Art. 15 to 21 GDPR and can lodge a complaint with a supervisory authority.

We update this policy when our processing changes. The version published on this page applies. The German version prevails.
